Terms of Use
Last updated: 10/28/2026
1. Educational purpose
All content created with this tool is intended for general educational and marketing purposes only. It is not medical advice, diagnosis, or treatment. No physician–patient relationship is created by access to, or use of, the content.
2. Ownership & license
Content, captions, designs, and images you generate belong to the practice account that produced them. You may not reproduce, redistribute, or use the content of other practices without permission. Stock and AI-generated imagery is used under the licenses of the originating providers (Unsplash, Pexels, Lovable AI). Photo credit is preserved where required.
3. AI assistance & transparency
Drafts, captions, and many images are produced with the assistance of AI models (currently routed via the Lovable AI Gateway, which proxies to OpenAI and Google). The practice account is solely responsible for reviewing every post for accuracy, applicability to its patient population, and compliance with state and federal law (including HIPAA, FDA promotional rules, FTC endorsement guidelines, TCPA, CAN-SPAM, BIPA, and state AI-transparency laws including California SB 942 and Utah SB 149) before publication. The tool surfaces an "AI-assisted" label on generated content and tags generated images with provenance metadata; you agree not to strip these disclosures.
4. Prohibited use
- No diagnosis, treatment, prescribing, or guarantees of outcome.
- No identifiable patient health information (PHI) in any prompt or post without written authorization. The tool's PHI scanner is a convenience — not a safeguard.
- No promotion of prescription drugs or devices by brand name in a manner that violates FDA, state pharmacy, or off-label rules. Brand-name flags must be acknowledged before publish.
- No fabricated citations, fake reviews, or AI-drafted reviews posted in a patient's voice (banned under the FTC Fake Reviews Rule, 16 CFR Part 465).
- No deepfakes, fake testimonials, or imagery implying a real patient outcome.
- No SMS or email sends to recipients who have not provided express consent (TCPA / CAN-SPAM).
- No upload of identifiable provider, staff, or patient biometric/facial data without written consent (IL BIPA, TX CUBI, WA HB 1493).
5. AI model training
Your prompts, generated content, brand assets, and patient-facing copy are NOT used to train third-party AI models. Lovable AI Gateway providers are configured with zero-retention / no-training enterprise terms where available.
6. No warranty
The tool and its content are provided "as is" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. AI output may be inaccurate, out of date, or non-compliant with your jurisdiction; you must independently verify before publishing.
7. Limitation of liability
To the maximum extent permitted by law, the tool's operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of use of the content.
8. Contact
Questions about these terms should be directed to the practice owner.
